Commission Junction Trademark Infringement Webinar - Brand Hijacking

March 30, 2009 by Evan

Commission Junction is having another webinar in their CJ webinar series. This time it’s focused on an issue that has persisted in the world of online marketing for years: trademark infringement and brand hijacking. Here is the break-down from the CJ website:

Every e-retailer is susceptible to the ever-growing practice of online trademark infringement that occurs when consumers mistype your domain name and are “hijacked” by fraudulent domain owners who make millions. This practice, known as cybersquatting — or typosquatting — costs brand holders millions of dollars each year in lost revenues.

In this Webinar, a domain recovery expert will show you how typosquatters thwart your marketing efforts and what you can do to:

• Protect your brand
• Recover lost revenue
• Prevent misdirection to competitor sites

Join Dave Duckwitz, CEO of CitizenHawk, and Jeff Ransdell, Director of Compliance and Support Operations at Commission Junction, to learn about typosquatting and find out who’s hijacking your brand.

This is a must because most companies are venerable to these types of practices by rogue affiliates and other individuals that would choose to damange a company’s reputation.

    Hi Alts,

I can certainly understand your viewpoint, in that domain resellers (of which I am one) purchase domains for the express purpose of reselling them to others at a profit. It really isn't hijacking, as long as you are following the "rules of the road" for the particlar extension under question (for example, nexus requirements, if any), and are not violating any pre-existing trademarks.

The reality is that the domain authority responsible for a particular extension (the applicable national registry) sets the rules regarding who is allowed to own what. Some registries are very strict, such as Australia, which requires a physical business presence in Australia related to the domain name in order to register a .com.au domain name. Others are very liberal, suck as the UK, which has no requirements at all for registering .co.uk domains (as long as you are not violating any pre-existing live trademarks).

The reality is that domain parking is not unethical, as long as you follow applicable statute, case law, and registry rules when you register a domain.

100 % I agree buying a down domain and fixing it to sell and gain profit isn't hi jacking it is just a way that you are using your skills to earn money like what you had said there are some rules that you nedd to follow for this activity

The best protection here is a live, valid trademark. "Typosquatting" falls under the aegis of "confusingly similar" domains, as long as the trademark effective date is prior to the date that the squat domain is registered. The critical thing is to keep your business or product name non-public until you have applied for your trademark. This will ensure the maximum possible protection for the legitimate business holder.

i think this hijacking must be stopped by the owner of the company together with the police cause if this will continue the company will be down and their product will be lost.

Really you would think companies would have wised up to cybersquatting by now. Its a practice that has been going on since the begining of the centuary.
